Why ALA Law

Warren family lawyers who understand life on the land

Family law matters in the Warren district often involve more than the family home. Cotton, cropping and grazing operations, water entitlements, machinery and family trusts can all form part of the property pool. We help you understand how they’re likely to be treated and look for workable solutions.

We act for families in Warren, Nevertire, Collie and the surrounding district, and we’re just as focused on helping parents agree on arrangements that put the children first.

Our team is led locally by Special Counsel Julie Vass and backed by ALA Law’s Accredited Family Law Specialists, giving you experienced advice on even complex rural matters.

FAQs

Questions for our Warren family lawyers

Do I need to travel to see a family lawyer?

Not necessarily. Most of our Warren clients meet with us by phone or video, and we share and review documents securely online. If you’d prefer to meet face to face, we see clients in Orange and Dubbo, by appointment only.

Are family trusts included in a property settlement?

They can be. Depending on who controls the trust and how it has been used, trust assets may be treated as property of a party or as a financial resource. Every trust is different, so specialist advice is important. We can review the trust deed and explain where you stand.

Where is the nearest Family Court to Warren?

The Federal Circuit and Family Court of Australia’s nearest registry is in Dubbo, with circuit sittings also held in Orange. You can file most documents online, and the Court holds many hearings by video.

Is there a time limit for a property settlement?

Yes. Married couples generally have 12 months from the date their divorce becomes final, and de facto couples have two years from separation. After that you need the Court’s permission, so it’s best to get advice early.

How long after separation can I get a divorce?

You must be separated for at least 12 months before applying for a divorce. You can be separated while still living under the same roof, but you’ll need extra evidence. If you’ve been married for less than two years, you’ll usually need to attend counselling first or get the Court’s permission.

Do I have to go to court to sort out my family law matter?

Usually not. We resolve most matters through negotiation, mediation or collaborative law, and consent orders can make the agreement legally binding. Court is a last resort, but if it’s needed we’ll be standing firmly in your corner.
