Why ALA Law

Narromine family lawyers who understand rural families

Separating when your home, income and family history are tied up in the land brings its own challenges. We help farming and small business families work through property settlements fairly and practically, with an eye on keeping operations viable where possible.

Just as importantly, we help parents put the children first, whether that means a parenting plan that works around school, sport and seasonal work, or formal parenting orders. Our clients come from across the Narromine Shire, including Trangie and Tomingley.

Every matter is overseen by our experienced team, led locally by Special Counsel Julie Vass and backed by ALA Law’s Accredited Family Law Specialists.

FAQs

Family law questions from Narromine clients

Do I need to travel to see a family lawyer?

Not necessarily. Most of our Narromine clients meet with us by phone or video, and we share and review documents securely online. If you’d prefer to meet face to face, we see clients in Orange and Dubbo, by appointment only.

How is a farm or family business divided after separation?

There is no automatic formula. The Court looks at the asset pool, each party’s financial and non-financial contributions (including contributions made before the relationship, gifts and inheritances), future needs, and what is just and equitable. Farms and businesses usually need a valuation, and we can help you look for options that keep an operation viable where possible.

Where is the nearest Family Court to Narromine?

The Federal Circuit and Family Court of Australia’s nearest registry is in Dubbo, and the Court also sits in Orange. You can file most documents online through the Commonwealth Courts Portal, and the Court holds many hearings by video.

Can a binding financial agreement protect the family farm?

A binding financial agreement (sometimes called a prenup) can set out how property, including farming assets, will be divided if a relationship ends. It must meet strict requirements, including independent legal advice for each party, to be binding. We can prepare or review one for you.

Is there a time limit for a property settlement?

Yes. Married couples generally have 12 months from the date their divorce becomes final, and de facto couples have two years from separation. After that you need the Court’s permission, so it’s best to get advice early.

How long after separation can I get a divorce?

You must be separated for at least 12 months before applying for a divorce. You can be separated while still living under the same roof, but you’ll need extra evidence. If you’ve been married for less than two years, you’ll usually need to attend counselling first or get the Court’s permission.
