Why ALA Law

Parkes family lawyers you can rely on

The Parkes district’s mix of mining, farming, transport and logistics means many families have incomes and assets that aren’t straightforward: rosters and overtime, farms and machinery, trucks and small businesses. We help you understand how these are treated in a property settlement or child support assessment.

Just as importantly, we help parents focus on the children, with parenting arrangements that work around school, sport and long or irregular working hours.

Our team is led locally by Special Counsel Julie Vass and backed by ALA Law’s Accredited Family Law Specialists, so even complex matters are in experienced hands.

FAQs

Family law questions from Parkes clients

Do I need to travel to see a family lawyer?

Not necessarily. Most of our Parkes clients meet with us by phone or video, and we share and review documents securely online. If you’d prefer to meet face to face, we see clients in Orange and Dubbo, by appointment only.

How is mining or shift-work income treated for child support?

Child support is generally based on each parent’s taxable income, which can include overtime and bonuses. If your income changes a lot from year to year, there are ways to have that taken into account. We can explain how it applies to you.

Where are AVOs dealt with in Parkes?

Apprehended domestic violence orders are dealt with by the Local Court. Parkes Local Court is at 37 Currajong Street. If you’re in immediate danger, call 000.

Where is the nearest Family Court to Parkes?

The Federal Circuit and Family Court of Australia has a registry in Dubbo and holds circuit sittings in Orange. You can file most documents online through the Commonwealth Courts Portal, and many hearings are now held by video.

How long after separation can I get a divorce?

You need to have been separated for at least 12 months before applying for a divorce. In some cases you can be separated while still living under the same roof. Parenting and property matters can be dealt with before the divorce.

Are de facto couples treated differently from married couples?

For property and parenting matters, de facto couples generally have similar rights to married couples under the Family Law Act, provided certain requirements are met, such as living together for at least two years or having a child together. The time limit for property claims is two years from separation.
