Why ALA Law

Bathurst family lawyers who explain things clearly

Bathurst families come to us with all kinds of situations: public sector and university careers, small businesses, investment properties, rural blocks on the edge of town and superannuation built up over many years. We help you understand how each of these is treated and what a fair property settlement looks like for you.

When children are involved, we focus on arrangements that work in practice, around school, sport, shift work and the travel between homes, so everyone knows where they stand.

Our team is led locally by Special Counsel Julie Vass and supported by ALA Law’s Accredited Family Law Specialists, so you get specialist family law expertise without travelling to Sydney.

FAQs

Family law questions from Bathurst clients

Do I need to travel to see a family lawyer?

Not necessarily. Most of our Bathurst clients meet with us by phone or video, and we share and review documents securely online. If you’d prefer to meet face to face, our Orange office is less than an hour away and we see clients there by appointment.

Where are AVOs dealt with in Bathurst?

Apprehended domestic violence orders are dealt with by the Local Court. Bathurst Local Court is in Russell Street. If you’re in immediate danger, call 000.

Where is the nearest Family Court to Bathurst?

The Federal Circuit and Family Court of Australia holds circuit sittings in Orange and has a registry in Dubbo. You can file most documents online through the Commonwealth Courts Portal, and many hearings now happen by video.

Can I move away from Bathurst with the children after separation?

If the other parent doesn’t agree, relocating with children can be complex, and the Court’s focus will be on what is in the children’s best interests. Get advice before you move, as acting first can affect the outcome.

Is superannuation included in a property settlement?

Yes. Superannuation is treated as property under the Family Law Act and can be split between separating couples. We can explain how a super split works and what it means for your retirement.

Is there a time limit for a property settlement?

Yes. Married couples have 12 months from the date their divorce becomes final, and de facto couples have two years from separation, to apply for property orders without the Court’s permission. It’s best to get advice early.
